It's a shame. People are dumping batteries and tires on the land without a word. These folks tried to make something beautiful and nice and the Feds are all over them.

Hence the reason for the 10th Amendment to the United States Constitution:

    Amendment X

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The EPA is an extra-constitutional agency whose existence has no basis in any constitutional argument. It lingers on only because Richard Nixon, a Republican, brought it to life and liberals morphed it into a monster.

The EPA has been getting more and more power. They will soon try to tell us that we can't collect rain water. The clean water act has so many far reaching applications that this is just a small instance of their claimed power. It is only the beginning. The loose term navigatable water can be applied to almost anything and any water source, as it is currently written.

IRS and EPA give the gov tons of power to screw with pretty much any American that needs to be dealt with.

    Interesting.

No, it's not interesting, it's scary. Using this same process, or perhaps precedent depending on how this case goes, the EPA can come after everyone who owns any property at all for stormwater run off. That means if it rains, and you don't have an approved drainage plan for the water running off your lawn or roof, you could be in for a fine. Car leak a drop of oil on your driveway? Or did you fertilize your yard or applied any weed killer or pesticide? Or do the plumbing vents on your house have a lead flashing on them? Well guess just what just washed off into the public waterways from your property?

It IS interesting, for a couple of reasons.

And this is not a new thing, if you are just now getting scared you are running a little late.

And no, I don't find this scary. It's not a good thing, but "scary" is not an accurate description.

Read post 8 if you would like my opinion on these things. Don't jump up and down because my emotional response is not to be "scared".
