Torrez was forced to drop the initial shooting-related charge of aggravated battery with a deadly weapon while the police investigation remains open.

However, he is still charging Baca with unlawful carrying of a deadly weapon for not having a concealed-carry permit, and also with three counts of aggravated battery for the melee that occurred at the statue immediately prior to the shooting, according to KRQE.

They are gonna get him on something. He was stupid to carry unlawfully then insert himself into the situation.

Regardless of the unconstitutionality of carry laws

    A) Hes an idiot
    B) The people who attacked him are idiots
    C) Why is everyone an idiot these days

Weird. Doesn’t do that to me using Firefox private.

    ETA: pertinent quote
“Second Judicial District Attorney Raúl Torrez announced his decision to resurrect the shooting charge at a news conference Monday afternoon. He also announced his office has filed a civil suit asking a judge to prohibit the New Mexico Civil Guard, a heavily armed civilian militia group, from “organizing and operating in public as a military unit independent of New Mexico’s civil authority” and from “assuming law enforcement functions by using or projecting the ability to use organized force in response to perceived threats at protests, demonstrations, or public gatherings.”

    See if this works.
A video of the "assualt". A lady is trying to use her body to push him where she wants him to be or away from where he is trying to go anyway. Just because you don't use your hands or weapons, it is still assualt and you can use force to defend yourself. Or from being unlawfully restrained.

The shooting happened sometime after that incident. Saying the violence was all his fault is a stretch.
One group there to destroy a statue unlawfully. Not discuss it's merits. One there to protect it. The article cites Police there with cameras and failed to act against a criminal behavior?
Unless the protectors were the first to actually commit a violent act, they are not the instigators. His acts did not warrant use of deadly force to stop him. If I was on the jury, he would walk.
And I would want to know why some of the other unlawful acts did not warrant arrests.
