    Cruz would be required to step down from the Senate prior to going through the Senate confirmation process. It would be a doozie, that's for sure. As far as a replacement in the Senate, that would be an issue for the State of Texas to deal with, NOT the GOP. The 17th Amendment provides (in pertinent part):

    "When vacancies happen in the representation of any State in the Senate, the executive authority of such State shall issue writs of election to fill such vacancies: Provided, That the legislature of any State may empower the executive thereof to make temporary appointments until the people fill the vacancies by election as the legislature may direct."
    Yes. Sorry, I wasn't as clear as I should have been. I meant would the GOP just name a candidate to run in Cruz's place in November, since we already had the primary and I would assume we wouldn't hold another. Of course Abbott would name someone to finish out Cruz's term.

    I guess I'm concerned we'd have another Roy Moore type fiasco, where we lose Cruz in the Senate, he doesn't get confirmed, and the Democrat sneaks in and takes the seat. The worst of all worlds.

    Hypothetically if someone failed confirmation could TX not then appoint them back to their seat? Assuming they didn't previously fill it.
    I suppose. But that would mean the state would have to be willing to let the seat be empty for potentially a very long time. I really doubt that would happen.

    I would hate for Abbott to appoint another Cornyn, but I'd deal with it if it got Cruz onto SCOTUS.

    Yeah, that couldn't realistically happen. The seat would have to be filled pretty quickly, especially with the GOP only holding a 1 seat edge. They couldn't wait around for a confirmation that the D's would try to drag out for months.

    I know we're just talking hypotheticals here, but quite frankly, Cruz could probably not be confirmed at the moment. He's on record as being staunchly pro-life, among other things, so he'd lose RINO Collins for sure and probably the RINO from Alaska whose name escapes me at the moment (Murkowski?). Flake would probably vote against him to spite Trump and McCain would probably vote against him to spite for both Cruz and Trump. Maybe if the GOP picks up Senate seats in the mid-terms it could happen, but if an appointment had to be made right now or this summer, Cruz would probably not be the wise political play unfortunately.

    CRUZ hands down. Ruth Ginsuberg has made quite a few public statements on her thought of the US Constitution, none of them positive, in fact she hates it. She is a bonafide nut job.

    While back I had breakfast with Cruz and spent about an hour with him mano mano: ONE SMART man, rock solid on the 2nd RKBA. He would be my first vote of SCOTUS, in fact that is his best job in life IMO. He is one of the few lawyers in the US can practice before SCOTUS. In fact that is where ole Ted make his money was a a very high powered corp lawyer taking cases before SCOTUS. He is own OUR team folks! IMG_0859.jpg

    I don't think he would have to resign his senate seat until he was approved for scotus.

    I believe this is true. Hugo Black (AL) concluded his Senate tenure one day AFTER starting his SCOTUS position in 1937 (see his bio in Wikipedia). Harold Hitz Burton (OH) ended his Senatorial position eight days AFTER he started his Associate Justice position on the SCOTUS in 1945 (reference his bio on Wikipedia). James Byrnes (SC) took 13 days to end his Senate career AFTER becoming an Associate Justice in 1941. There may be others but I grew bored looking.

    That makes no sense. The guy is a constitutionalist but that is the reason why they chose to vote for someone that not too long ago was ok with forced confiscation or privately owned property and trampling on your due process rights.

    Cruz part of the old boys club?? He’s ostracized himself from that old boys club by publicly calling them out on their lies. The Freedom Caucus is far from being a good old boys club.
