    I agree with that; if you’re going to revert to on-duty, then on-duty rules apply. Part of clearing is identifying friend/foe before engaging, because you can’t take that bullet back.

    Which is why I go feel it is unreasonable to believe she should have feared for her life.

    Then doing that one handed while calling or texting. Prosecution using that against her. Stating the vic deserved her full attention (both hands)

    WTF? You do not do chest compressions on a bleeding person who is alive. What voodoo first aid is that? Jeez, does she know she actually hastened his death by getting his heart to pump faster and lose more blood? Civil lawyers are fapping right now at that statement.

    And if she was doing chest compressions, how come no part of her clothing had blood on it? And yes it was all tested.

    She is either lying or a complete moron.

    Basically she made 2 attempts to kill him. Shooting did not work, so she tried to pump him dry of blood.....

    Well if the thinking is someone is in my home most are not going to try to find out more info.
    Especially if they don't follow your command to get on the floor. Maybe he was shocked and was attempting to get off the couch? That is believable as well as the officer thinking he is getting up to attack me.
    Some attorney was saying there really is no precedent for this and that is why everyone finds it so interesting.
    I wonder if the family will sue DPD and the apt complex civilly after this trial. I bet they do and they should.

    #1 I think it’d be a good idea to assess the situation before firing if it could be done safely.

    #2 I heard her say “show me your hands”, not “get down.” How did she know he wasn’t trying to comply? She said it was dark. I didn’t hear her say where his hands were.

    Yes the fact she didnt have blood on her was mentioned.
    It might have been heart massages now I think about it.

    It was also shown she was in her car when dude was wheeled out on the stretcher and she was surfing on her phone.

    Yeah, I couldn’t believe that. I know nothing about first aid (I should learn) but I would think one would want to stop the bleeding first.

    I've read all 90 pages on this thread. Just caught up.

    The fact is she entered someone else's home. Then she shot them. To death. Not her house. No legal or justifiable reason for her to be there.

    If anything, her being an officer makes her 'more' guilty- to me, at least: I expect cops to be able to work schedules such as she worked that week and still make critical, life-altering decisions- and come out the other side having mostly made reasonable and prudent decisions.

    Sorry that she was confused, but I don't think that's a sound, or legal, defense. Otherwise, we should all get out of tickets whenever we're confused about where the speed limits change...

    Manslaughter for sure. If she shot him for non-compliant behavior (which she would in all probability have perceived as a threat), she was unjustified because he was in his own home, hadn’t committed a crime, and he had no obligation to comply under the circumstances (because she was disoriented); however, I am guessing that if he had reacted cooperatively with a sense of humor, he would still be alive. Bad luck all around.....

    I thought 2 rounds center mass 1 miss.
    Still whole patrol divisions have fired dozens of rounds at that distance and all missed or made only peripheral hits, rather routinely I might add.

    Off the top of my head See NYPD.

    13 feet isnt that close under stress with a handgun, real stress or self induced.

    Hell, I've seen lots of Police and Corrections officers miss whole strings of fire at 3, 5 and 7 yards practicing for qualls.

    Just sayin.

    Right on! I recall a report from many years ago where a NYC Detective attempted to arrest a subject on an elevator. Both the Detective and the subject emptied their weapons between floors. No hits! I bet their ears are still ringing!!! LOL

    I was empaneled on a murder trial under Cruzo, declared mistrial cause the deceased name was incorrect. Proper, just get it right and re-try. So much improper actions in this case an appeal is almost a given.

    pretty much all incorrect.

    all that evidence was entered. Only the lead investigators opinion of guil or innocence was excluded. We covered this a few pages back

    I guess people don't understand that by stating the apartment was "dark" doesn't necessarily mean it as devoid of all light. If silhouetted from behind by light colored walls, she easily could have seen his hands albeit only from the outline of this body. When those hands dropped (if they were ever raised at all), or she realized his movement towards her, she could have justifiably "feared for her life."
