    I hope you're right because NBC (I'll never repost a link of theirs, screw them) is reporting the deal is done in the Senate, and the text is now being finalized. We'll see.

    WSJ is as well. The only thing I can’t figure out is if this is getting by under reconciliation rules or not since there’s many billions of dollars in fed funds that will go to states with ERPO laws or contingent on states passing ERPO laws on top of the mental health dollars, too.

    I think once everybody figured out they could get something under gun control could be done AND hand out shittons of money, then it was a matter of time.

    One problem with the bill, regarding who must have an FFL

    Defining Engaged in the Business
    ...by striking ‘‘with the principal objective of livelihood and profit’’ and inserting ‘‘to predominantly earn a profit’’...

    The term ‘to predominantly earn a profit’ means that the intent underlying the sale or disposition of firearms is predominantly one of obtaining pecuniary gain, as opposed to other intents, such as improving or liquidating a personal firearms collection:

    This is extremely vague and could be warped to catch anyone.

    Then there is the red flag issue.

    It's potentially a big problem, yes
    OTOH, if you sell 100 guns a day for exactly what you paid for them, then you have earned 0 profit, so you are totally exempt from the law.

    I think the average gun owner doesn't sell their glock 17 for more than they paid, especially in adjusted dollars.

    But "predominantly" is an easy out. All you have to do is say you sold the gun for a profit, yes, but the price was in keeping with market value, and the main reason you sold it was because the gun was giving you blisters, and now that you have sold it you can shoot without physical discomfort. At that point, the predominant reason for the sale isn't profit, it's comfort.

    The govt bears the burden of proof, not you.

    If governmental abuse/overreach are your primary concerns, then this law doesn't change a thing from your perspective. The gov can make up all kinds of BS and falsely prosecute you for years right this very minute, without this bill ever getting out of the Senate.

    I’m more generally concerned that .gov traditionally used knowingly and willfully/willingly as the standard to establish the mental state for criminal intent. Watering it down to just willfully puts it in essentially the same mental state as negligently or recklessly.
