    so, having just moved back to texas, i still have an out of state ID. i have not had any bills come in yet, just 401k statement. what satisfies proof of residency, if anything at all, with out of state ID? i went to sportsmans outlet and they told me i had to get a texas ID and then wait 30 days from the time it was issued along with proof of residency. i have not come across anything that talks about new resident purchases.

    You need proof of residency to buy from an FFL, but you don't have to wait 30 days. I had just retired from the military and still had my old Florida drivers license when I went to buy a SA XD-45 from Sportsman's Warehouse. They could no longer accept it like they had while I was on active duty, so I drove over to the DMV and got a new Tx DL, then drove right back to the store and picked up the pistol.

    For private sales, some people want some proof of state residency but the law only requires the seller to not suspect you are ineligible to own the firearm. If you have out-of-state tags on your car it might cause them to ask, but otherwise it probably won't be an issue.

    Your best bet is to get Texas ID as soon as you can. It only takes an hour or two at the DMV to get a temporary license (sometimes even less if you're lucky enough to go there on a slow day, but those are rare), and those do have your picture on them.

    Just remember that a store/FFL can refuse to sell you for any reason. If they won't, don't get upset as there is no way you can force them to do so. Just do your best not to give them any reason not to, and all will be well! Most stores will do their best to accommodate you, but not if there is any reason to suspect you are not legally able to purchase the firearm!

    Do a "Want to Buy" thread on here and purchase it in a Face to Face transaction from a member here. I am pretty sure every gun you would be in the market for can be found from a member here. Only issue is you will probably not get a new in the box one, but heck after the first session at a range, that's gone.

    Second Acera's comment. Every new gun I've ever bought was used 30 seconds later - even if never fired. So, I generally avoid new guns any more....generally, I said.....<G>

    i dont mind buying used, my last AR build had some used parts:P and that definately was another idea of mine, but wasnt sure how many are in the houston area to do so.

    lol, i meant from the forum to do so. i guess i could post an ad on craigslist as well. i try to buy from forums and forum sponsors mainly. this makes it easier for me to trust i have a good purchase and helps out another forum member.

    Or you could always offer up a "guaranteed buyback" program on an M&P45. Just let people know that if they call you and confirm ahead of time, they can go buy themselves a brand new M&P45. Tell them that as long as they don't shoot more than 50 rounds through it, if they don't like it for any reason, you'll buy it from them for the same price they paid within a day of them buying it.

    Get's you a 50-round used gun if they decide not to keep it and gives them the chance to buy a gun, go try it out, and then have a guaranteed sale if they don't wanna keep it. Win-win.

    hmmmm....M2 - you sure about that? Always been my understanding that it had to be 30 days after.

    That was my experience back in 2006, and in those days the temporary Texas driver license didn't even have a picture on it. I thought it odd as well, but since I had my military ID card as well, they had no problem in processing my purchase.

    My wife subsequently lost her drivers license a few years back and got a temporary one (guess who had to take her to the DMV? ). I noticed they now have pictures on them.

    The 30-day thing may be how long it takes to get the permanent drivers license, but according to the ATF "a purchaser may be identified by any combination of government-issued documents which together establish all of the required information: Name, residence address, date of birth, and photograph of the holder." (per 27 CFR 478.11 and 478.124(c)).

    As for the 3-day requirement, I know you have to get a Texas drivers license within 30 days of arriving here; but I am not aware of a minimal amount of time you have to spend in this state to officially be a resident...does anyone?

    I would like to know what the law actually states, because I bought a gun within an hour of "officially" becoming a Texas resident!

    Now, granted I was stationed here for ten months as active duty military prior to that; but the ink on my temporary drivers license barely had time to dry before I was using it to buy a pistol! But as far as the FFL was concerned, that was my proof of residency even thought it was less than 60 minutes old (probably closer to a half hour, honestly*).

    By the way, that sounds pretty cool, doesn't it? "I bought a gun within an hour of "officially" becoming a Texas resident!" I ought to make that my signature line!

    * - Just a little war story, but actually it took me about three hours to get my drivers license. I left Sportsman's Warehouse and went straight to the DMV, but I couldn't get my license because I didn't have a Texas vehicle registration on me. I ended up having to drive all the way home to get the one out of our minivan, which was registered in this state, and going back to the DMV. Luckily, they let me jump the line since I had been there earlier. But once I had my new temporary Texas drivers license, I bee-lined it back to Sportsman's Warehouse to get my XD!
