Business owners: right to refuse service to anyone?

    So we talk a lot on here about our rights: legal rights, natural rights and the rights we think we should have.

    Weekly now there are news stories about Christian businesses being punished for not being willing to engage in commerce that violates their faith.

    This isnt just about that though. We also talk a lot on here about property rights especially regarding 3006 and increasingly open carry. I know this is different than homosexuals demanding the gov force a business to engage in commerce with them or be punished.

    Big picture what rights should businesses/individuals have, when it comes to refusing service and conducting commerce freely as they see fit? Should anyone be compelled into engaging in commerce with another? Because as it stands now, they cant refuse service to anyone especially those of certain groups. I not only see increasing persecution for Christian businesses but political persecution as well, such as Operation Choke Point.

    What groups should be protected if any? Federal groups are: Race, color, religion, national origin, age, sex, pregnancy, citizenship, familial status, disability, veteran status, genetic info?

    Much of the religious economic persecution is coming from state levels which can create their own protected classes.

    Much of the political persecution such as Operation Choke Point is not based on any protected classes at all and is merely capricious targeting of businesses the current administration deems to be unwanted/dangerous/predatory or otherwise to have a negative impact on society.

    Should a guy hosting a fashion show be forced to hire pregnant models?

    A cool hip downtown bar should be forced to hire an 80 year old bar tender?

    Im sure the Black Panthers have a business office somewhere. Should they be forced to hire a cracker like me? Should I be able to hire them as security for a whites only meeting?

    If I am a Catholic should I have the right to refuse to sell flowers to a protestant wedding party?

    What if I am a Chinese immigrant? Should I not be able to refuse service to Japanese?

    As a man, should I be able to refuse service to women? Men only clubs (Insert joke here)

    Should a gas station owning Native American be able to refuse service to a US Army convoy that wants to refuel?

    Should a Black property owner be forced to rent to the descendents of his family's former owners?

    Should a Jew in the US have to rent to the Palestinian Hamas family that blew up his family?

    Should a gun shop owner be forced to sell to a city police force which is hostile to gun owner rights?

    If we dont have the right to choose when it comes to engaging in commerce, what rights do we really have at all?

    Obamacare was essentially the nail in this coffin. When SCOTUS allowed the government to force people to engage in commerce, that emboldened those who seek to regulate commerce all the way down to the buyer seller relationship.

    Since states can create their own protected classes, maybe thats the way to use the system. Texas could create a protected class of people engaging in firearm commerce, Christians as a protected class and so on. But that would only serve to allow these groups to do business as customers. It wouldnt protect their right to property and free association and conducting commerce freely.

    So this brings us back to the original question. Should any groups be protected and should anyone be forced to conduct commerce with another?

    At this rate, those with strong convictions, whether religious or political, will eventually be forced into an underground economy.

    In this day and age, I say leave it all up to the market.

    If you make a stupid decision and your market punishes you for it, so be it. Too bad if you go out of business but that's life.

    And if you make a brilliant decision and your market rewards you for it, good on 'ya.

    It is not the govts place to pick winners and losers.

    Agreed. The .gov should stay out of it. But they don't.

    I know ive muddied the waters a bit. There is employment discrimination (refusing to hire a Black guy because he is Black) and there is economic discrimination (refusing to sell to a Black guy because he is Black).

    In California, as a business you cannot discriminate in hiring due to a persons political affiliations. So the local GOP office cannot refuse to hire democrats?

    The federal and state laws regarding hiring are more clear than the others to me. I also understand (not that i agree with) the housing fairness (or whatever) laws but not the ones that are being used in forcing businesses to do business with "protected" groups more generally.

    The Federal Civil Rights Act guarantees all people the right to "full and equal enjoyment of the goods, services, facilities, privileges, advantages, and accommodations of any place of public accommodation, without discrimination or segregation on the ground of race, color, religion, or national origin."*

    So combining that with federal employment, housing and state anti-discrimination laws that is where we are.

    Where we are going: there is currently a big push to read more into these laws than is there, expand them via lawsuits and legal rulings and to push for more protected classes on both state and federal levels.

    So now that we know where we are, where should we be and how do we get there?

    Federal civil rights act is now only responsible for protecting the rights of ethnic minorities, women, gays and other msnbc people. Business owners and whites are not to be protected.

    Anytime you intentionally or unintentionally impede on the wishes of a person or group protected by the civil rights act you will pay the consequences. It's all the republicans fault for being successful and hating minorities, women, and gays for so long.
