    While most of the pro-gun agenda is either stalled or going nowhere, one piece of legislation is fast-tracking through the legislature.

    A Senate committee voted Wednesday to let legislators, statewide elected officials and U.S. attorneys carry concealed handguns to locations that are off limits to most holders of handgun licenses.

    A bill approved by the Criminal Justice Committee would let those government officials pack concealed weapons at sporting events, and in churches, hospitals and bars — even in businesses that have a policy prohibiting people from carrying handguns onto their premises.

    Sen. Dan Patrick, R-Houston, author of the bill, said he was trying to simplify things for government officials who have a concealed handgun license and want to carry a weapon when they are traveling, sometimes to multiple locations for speeches or other events. Officials have to leave their handguns in the car or risk violating the law if they carry a weapon into a place that does not allow them, Patrick said.

    The measure, which now goes to the full Senate, would also cover former legislators and selected officials from the Texas Department of Public Safety who have a license but are not peace officers.

    This is about as outrageous as it gets.

    What's the problem? The requirements to become an elected official aren't strict. I don't even think there's a proficiency test. Anyone can qualify. If you want to carry in TX just become an elected official...

    What bill number is this? We need to get the names of every Senator who voted for this bill but against campus carry and publicly expose them.

    I hope this gets voted down. If the tax payers don't get it they shouldn't, either. Their lives are worth no more than ours and they don't have to deal with "The real world" nearly as much as we do.

    I can't stand Dan Patrick. He acts pro gun but isn't. I remember him crying gun control about something back in 09.

    Wow what a horribly written bill. Instead of putting it in 46.15, he put it in as a defense to prosecution in 46.035. Thus it really does not give them 100% carry protection from 46.03. Then he expires it in 2020, even dumber is not using a odd year. WTF.

    A BILL TO BE ENTITLED​
    AN ACT​
    relating to the application of certain concealed handgun license laws to statewide elected officials, certain current and former members of the legislature, and certain state employees.
    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
    SECTION 1. Section 46.035(h-1), Penal Code, as added by Chapter 1222 (H.B. 2300), Acts of the 80th Legislature, Regular Session, 2007, is amended to read as follows:
    (h-1) It is a defense to prosecution under Subsections (b)(1), (2), and (4)-(6), and (c) that at the time of the commission of the offense, the actor was:
    (1) a judge or justice of a federal court;
    (2) an active judicial officer, as defined by Section 411.201, Government Code; [or]
    (3) a district attorney, assistant district attorney, criminal district attorney, assistant criminal district attorney, county attorney, or assistant county attorney;
    (4) a statewide elected official;
    (5) a member of the legislature; or
    (6) a noncommissioned employee of the Department of Public Safety, designated by the director of the department.
    SECTION 2. Section 46.035, Penal Code, is amended by adding Subsection (h-2) to read as follows:
    (h-2) It is a defense to prosecution under Subsections (b)(1), (2), and (4)-(6), and (c) that at the time of the commission of the offense, the actor was a person who, on September 1, 2011, was serving as a member of the legislature and possessed a concealed handgun license under Subchapter H, Chapter 411, Government Code, if the person is no longer a member at the time of the offense and if the license has not yet been subject to renewal since the person ceased to be a member. This subsection expires on September 1, 2020.
    SECTION 3. The change in law made by this Act applies only to an offense committed on or after the effective date of this Act. An offense committed before the effective date of this Act is governed by the law in effect on the date the offense was committed, and the former law is continued in effect for that purpose. For purposes of this section, an offense was committed before the effective date of this Act if any element of the offense occurred before that date.
    SECTION 4. This Act takes effect September 1, 2011.

    And no protection from 46.03. School carry would remain a felony.

    You would think most legislators spends more time in 46.03 places than 46.035. I mean, 46.035 is a bar, a prison, or sporting event. I would much rather have school & court protection (especially since many legislators are lawyers). Especially the felony vs misdemeanor angle.

    I would think so too. Probably many of these people haven't bothered to read the bill.
