    My overall opinion on this case:

    1) I thank God that I was not among the Officers involved in this incident.

    2) I thank God that I will not possibly be called to sit on the Jury that will ultimately have to decide on this matter.

    If I was in charge at the scene at which there is probable cause to suspect a burglary and we had enough Officers available:

    1) Stealthy vehicular approach.
    2) Quietly station (2) Officers at opposite corners of residence (no flashlights).
    3) Stacked (2) at the Doorway and loudly announced, “Police!” “Anyone here, identity yourself!”
    If no answer,
    4) (2) Stacked Officers clear the building.
    If resident answered, I’m here, it’s MY HOUSE!”, or Burglar, “Please don’t shoot” or something....
    5) Command, “Face the wall with your hands on your head.” “ We are coming in!” “ Do not move!”
    Or, if after the initial warning the occupant reports,”I can’t get up because: I’m hurt....sick....disabled etc,
    6) Stacked Officers would clear the occupancy cautiously.....

    Anyway, that would be how it should go in my perfect little world.....

    When a murder occurs during the commission of a crime, there is an intent to commit that crime shared in common among all the perpetrators involved;
    Is the intent to which you're referring a legal or psychological concept?

    It doesn't apply in this case, obviously, but the concept of felony murder, which we have in Texas, establishes a way to convict someone of murder even if they had no psychological/emotional intent to cause a death and didn't directly do so. Intent, in the way non-lawyers and non-LEO think of it, isn't always a required element of a murder conviction.

    Somebody got the video of Aaron Dean's hiring interview. I'm not sure if the prosecution can or would use this, but it certainly paints the guy in a worse light. He said he likes action and adventure, wishes he joined the military.

    Liking action and adventure is not a negative. Wishing you had joined the military isn't either. This video is edited in a manner to make him look bad. If he said he wanted to join the military to kill as many people as possible that would be a problem. We don't know how he expanded on that from the video.

    No context. When I interviewed for my LE position I was asked if, in the course of my work, I was in a situation that required the taking of a life would I be able to do so.

    A no answer would be a disqualifier.

    Again, context is important. I would love to see the entire interview.

    Well if you want context, watch the video. And the context is the problem. He was almost gleeful, like killing people was like stepping on cockroaches, and he looked forward to the opportunity. If killing people is not a problem, you are not the solution. I am surprised he did not jump up and down like Arlo Guthrie.

    And I went up there, I said, "Shrink, I want to kill. I mean, I wanna, I
    wanna kill. Kill. I wanna, I wanna see, I wanna see blood and gore and
    guts and veins in my teeth. Eat dead burnt bodies. I mean kill, Kill,

    KILL, KILL." And I started jumpin up and down yelling, "KILL, KILL," and
    he started jumpin up and down with me and we was both jumping up and down
    yelling, "KILL, KILL." And the sargent came over, pinned a medal on me,
    sent me down the hall, said, "You're our boy."

    Watched it again. He was smiling/smirking as the question was asked, shook his head Yes, while closing his eyes and said "No Problem" and kept that smiling/smirk on his face.

    I do not hire people who think killing people is "No Problem". No soup for you, Next! YMMV. Love to see his interview with the shrink.

    I don't twist everything I write to support my POV, either.

    Coming from the guy who has never admitted a cop was in a bad shoot.
