Cruz is in the minority party in the Senate and the chairman was not going to allow him to have unfettered access to Feinstein... the chair allowed Durbin to make the child porn argument which was out of order as he was not being questioned and it was Cruz' time.

The first and the fourth do not contain the language... shall not be infringed. That is significant when they come up with lame exemptions to the first and the fourth.

    Great point

Cruz has a style -and he's going to find that berating an old woman - even one like Feinstein -isnt going to play well in the press

i was on the elliptical yesterday at the gym and CNN was giving Feinstein the chance to tell how she was mistreated - how she was the victim, poor poor me - because of the bully Ted Cruz

we all know thats BS - but frankly the press and left - LOVE THAT.....Cruz can't be a bull in a china shop all the time - he needs to remember who his audience and enemy are - they are different in every situation

    Great point

I watched the exchange in real time. Senator Cruz was cool as a cuccumber the whole time. He never strayed from his simple question for the anti-2A crusaderess. Finally, after alluding to her privilege of "rank" (in the absence of any factual argument) she responds - " NO."She would not deem it appropriate to apply the same standard of infringement to the 1st , or 4th Amendments.

Feinstein's single point is that she has come to understand that - guns shoot bullets that can maim, and kill people. This astounding observation undoubtedly was overlooked by the framers of the Constitution. Why would a people want to maintain a militia that had arms that were capable of such horrible injury to invading armed forces, or domestic tyrants ? The U.S. government should not allow the people to be equiped with such unspeakable arms with which they could withstand tyranny or foreign invasion. Therefore the 2A must necessarily be "overridden " by statute , and the SCOTUS....

And this Senator has studied the Constitution, and has been "close and personal with the Constitution".....revealing her propensity for antagonism to it.

    Good job Senator Cruz !

Okay, I am still stuck on what Sen. Durbin said towards the end of the video.
    "no rights are absolute"

    WHAT?!

I see your point but he has one too. Their response was stating that child pornography was banned. That's pretty lame. sexual relations with a child are illegal so there is no 1st amendment right to say, publish a book about it.

It also seemed like they didn't give him a lot of time. Maybe as he gains experience he will learn to use his limited time better.

This is my thought. Child pornography is a crime because it involves sexual abuse of a child, however there is legal porn that involves adult women portraying underage girls.

It's no different than making a violent movie. It would be very illegal if they actually shot people.

For that reason I believe the first amendment argument is valid. It should also be considered that the first amendment is also the right of peaceful assembly. Should we pick and choose what we may peacefully assemble and petition our government about.

I voted for Cruz twice, support him fully, like how he bitch slaps the entrenched worthless bastards in Congress and how he kept his cool while she did not.

My favorite part may not have been noticed by others, The title termed that an "explosive exchange." Where I came from (Chicago) an explosive exchange would leave hair, teeth and eyeballs all over the friggin room. That nest of trash has been in the business of screwing the US citizens, unrestricted for way too long.

Cruz isn't in Congress to support business as usual. He is there to CHANGE the way they do business!

Go Ted Cruz! Don't let up on the bastards for one second!

The amicus brief is the "Friend of the Court" and it's a big deal. I didn't know Cruz did that.....Thanks!

On the exchange in the committee meeting, Cruz stayed on the subject even when Feinstein tried to avoid and evade the question. He kept steering her back to the question. She finally relented and gave him an answer. That was some fine debating on his part and it really got under Feinstein's skin. That was priceless!

Please remember, we didn't send Cruz to Congress to blend and become part of the ineffective and unproductive rabble. I voted for him so he would stand up, stand out and buck the system. He has exceeded my expectations already!

    Go Ted Cruz!

aside from the obvious child porn argument - there are MANY other types of speech that are not protected - so using that as your leverage in a 2D argument is 1st year law school student stuff - he should be better than that. it's a straw man argument in my opinion

apples to oranges. stick to the facts - find the facts that support your side -not some theoretical hypothetical - because those get picked to pieces

The only speech that's not protected that I can think of is speech that directly harms other people. Starting a panic (AKA yelling fire in a theater). Starting a riot. Libel and slander. Child pornography (have to harm children to make it). And on and on.

    His argument is solid.

I rather enjoyed the squinty-eyed sneer that Feinslime was giving Senator Cruz during his explanation of the 1st, 2nd and 4th Amendments. You could see she was pissed off. She obviously didn't like the "Shall not be infringed" comment. Feinslime's response, as noted, was emotional and non-factual. Her "I've seen people shot" is her relief that she wasn't in her office the day that White shot Moscone and Milk. Otherwise, by speculation, she would have been shot by White as well, because he went by her office on the way to kill Moscone and Milk.

Feinslime's past comments belie her "I've studied the Constitution" bullshit and she's on record noting that if, during the first AWB, the votes had been there she'd have had every gun confiscated.

this may not be a popular response - but i thought Cruz really missed an opportunity yesterday.

instead of playing cutesie with Feinstein with the constitutional argument - and allowing them to come back with the emotional response - why not ask her what her plans are for those thousands of guns in the ban list that already exist - what does she plan to do with those? and get her on the record about potential registration and confiscation......they completely avoided discussing anything of substance yesterday and spent a lot of time on the fluff. the 1st amendment comparison is a poor one - because NOT ALL speech is protected by the first amendment. many people think the contrary - but it's just not true

i would have preferred it if Cruz had come back with facts on crime data, and gun control legislation - is her plan a workable solution or is it just an emotional response (which it is)

i love what Cruz has done so far but he really missed a great opportunity yesterday.

The reason this is an effective argument, vs spewing a bunch of statistics which moves most of us.
1 people think it will never happen to them.
2 banned books is a liberal sacred cow.

To correlate guns in the second amendment to freedom of speech and banned books is brilliant.

Cruz isn't going to play well with the press, because there is an R next to his name. You can berate, assault, woman all you want as long as your name is Clinton or Kennedy...

Cruz gave Swinestein a little taste of what is to come. Her rein of terror is at an end. Flash would prefer that he twist the bitch's neck like a chicken. Cruz is smarter than that. He'll come back to fight another day! It's best not to show all of your best tricks up front. Now that we know her breaking point, he'll wait, set her off again and make her look like a bigger fool. The idea is to get that carpetbagger OUT of the Senate.

I'll take Cruz's expertise in Constitutional law over your opinion. I think he was on point and made the Wicked Witch of West look like the first year law student. She blathered on her about her years in the Senate instead of answering the question. He also got the Dems to state they are relying on the Heller case to support their ban knowing they aren't as well versed in the details of the case like he is. I have a feeling that was a trap question.
