    Seriously, this guy was obviously thinking with the wrong head. He's tech-savvy. He knows that he can't trust a web site to validate users sufficiently. Just the fact that she was selling her body through a web site restricted to 18+ doesn't mean she wasn't lying.

    He had to know that. But when you're not using your brain, you can do really stupid stuff.

    I'll submit this is a possible set-up... just based on the info in the article, if there was someone I really wanted to go away (and be discredited), and I was willing to spend lots of time and effort...

    You could set someone up like this- it would take planning, and effort...
    You don't even need the charge to stick, turn public opinion against him (just a good portion of those that don't already hate him)

    Oh, I'm also open to the possibility he's just "thinking with the wrong head", and is guilty as sin.

    But if I really wanted revenge on someone... fate worse than death being labelled a sex offender if you're not... can't get a decent job, can't see your kids (if you have some already), shunned by virtually every social circle...

    It is not that hard to go into a machine shop and make a gun.

    I truly wish I could remember who it was that said it, but my brain is not what it used to be, but maybe? Will Rodgers said he could make a gun in his garage in under half an hour.

    What kind of spin is this? From the story:
    Officer told reporters that detectives believe "if someone mistakes [the alleged victim's] age it would be because they think she's younger, not older than the 16-year-old that she is."
    We've all seen 20 year olds who could pass for 12 and vice versa. Why would that police commander feel the need to spin the story like this?

    Clearly he should have asked for ID. My goodness what a mess.
    I can understand someone who isn't tech savvy thinking that the web site through which he contacted the hooker screened for age. This guy should have known better.

    No one selling their body is going to provide ID to a john. If said john goes looking for legal-age teens to pay, he's just begging to make a mistake that will put him in a world of life-long legal pain.

    Common sense would be that if they're in a bar they are over 21.

    This girl set up an account on a website to sell her body for sex. IMHO at that point she's an adult.

    Yeah, I'd have to say that talking to an underage girl online and luring her into having sex is one thing, an underage girl that has been prostituting herself for money is a bit different. I don't advocate either, but I don't think the penalties should be equal.

    Is mens rea an essential element of whatever crime he's going to be charged with? In most of these types of crimes, it is not.
    The Jailblazers got off because the girls were in the bar with fake ID.
    In that case, most people without lots of money and a famous name are still SOL. Yes, famous athletes can get away with it for multiple reasons. Normal folks aren't that lucky.

    Even the prosecutions of the first people to shoot Traci Lords (Damn that bitch to hell!) were on track to get convictions until the defense pointed out that they checked two forms of ID and Lords had a valid U.S. passport. If the State Department couldn't catch that she was lying, how could a small production company in the valley be expected to do so? Even though they were technically guilty, the judge dismissed the charges.

    That sort of dismissal is rare, rare, rare.
