    He will be. If you read 9.32 of the penal code, as well as 9.42 it seems clear to me he met the justification required for the defense to prosecution for using deadly force.

    I believe the intruder did get a warning. It said, "Thou shalt not steal." Of course since the intruder was probably a welfare kid growing up, it was only one of the ten suggestions and not really a commandment.
