I worked for a woman who graduated from West Point and I asked her one day about the training she received. "Oh, West Point is just like a regular college with some marching and physical training thrown in." She was hired because she had West Point on her resume and the company was absolutely sure she would be the dynamic leader that they needed. The average kid with a month's worth of experience working at McDonalds has the same leadership skills as my old boss. She was pretty good at groveling to the higher ups, if you consider that a job skill.

Given my fairly recent run-in with BCSO and recent videos of LEO in Texas, and other places to be fair, I just have one question.
Where in the hell are they finding these people these days? Ok, 2 questions. Are they even trying to find someone with the confidence to do the job or just taking any warm body that wants it?
Hernandez and those 2 lady LEOs that did multiple mag dumps at the mere sight of a gun were clearly scared shitless. Hernandez even dropped his spare mag and then crawled away from it. WTH????

    That place east of Waco....
    Findings:
    Deputy Jesse Hernandez
    1. The facts and evidence show Deputy Jesse Hernandez's use of deadly force against Mr.
Jackson was not objectively reasonable. OCSO General Order 11.03, Section E,
Paragraph 35, Excessive Use of Control to Resistance is SUSTAINED.

    Sergeant Beth Roberts
    1. The facts and evidence show Sergeant Beth Roberts' use of deadly force against Mr.
Jackson was objectively reasonable. OCSO General Order 11.03, Section E,
Paragraph 35, Excessive Use of Control to Resistance is EXONERATED.

So....it's OK to start shooting as long as another LEO is shooting, justified or not?

Sounds like justification for mob mentality over assessing the situation....

He should have been at least frisked. Really bad idea not to...

In a different article it stated he had been searched and handcuffed prior to being put in the patrol car...

    Plus, per the report...

"At 0912 hours Sergeant Roberts told Deputy Reyna and Deputy Hernandez to detain Mr. Jackson. They handcuffed him and walked him to Deputy Hernandez’s patrol vehicle. Outside the view of Sergeant Roberts, Deputy Reyna completed a more thorough search of Mr. Jackson while Deputy Hernandez was present. Mr. Jackson was physically compliant."

Now, a big acorn can be pretty loud, its not that far fetched to *consider* if it might have been a gunshot, HOWEVER...

Being a cop is a thinking man's game. You hear a loud bang that you think is a gun shot coming from your searched and handcuffed prisoner? If you lack confidence in your search abilities so you think you missed a gun, that alone should disqualify you.

But that aside... what is the totality of the circumstances? You heard a loud bang come from your police car. Is any glass broken? Any bullet holes? Any signs of continued "gun shots"?

Why was the prisoner not being watched? Maybe thats not policy everywhere, but we are required to keep eyes-on once they are handcuffed, including in our cars. If nothing else for medical emergencies but folks have tried to strangle themselves with the seatbelt before..

In short you cannot just head a loud bang and go blasting your prisoner absent additional evidence, especially if he had been searched or frisked. "The prisoner is shooting at me" is not a reasonable conclusion from hearing a loud noise.

Lowering hiring standards has a high cost.

About 15 years ago, a veteran HPD Sergeant was killed by an illegal felon who was cuffed in his back seat. Story was that he had done a pat-down, but missed the gun. Officer was dead but felon was still trapped in unit and was soon in proper custody.
