Your vehicle is considered your castle (house) in Texas. It is legal to have a weapon in your house (vehicle) and what the legislation is making clear is that an employer does not have the right to tell you what you can have in your house (vehicle) if you can legally own a weapon. You don't need a CHL to own or keep a weapon in your house or vehicle. This was made clear by the castle doctrine two years ago.

The way I read it is like a list, you don't have to add and or or between every item, just before the last item. ex; grapes, apples, bananas, or oranges. A comma between items with the conjunction immediately before the last item.

who holds a license, who otherwise lawfully posses, or who lawfully posses ammunition...

    They should have written it like this;
Besides, if one has a CHL, it's inherent that they can lawfully posses guns. They wouldn't need to add that 'otherwise' unless they intended for those without a CHL but still lawfully possessing to be included with the bill.

I do agree that it's quite vague and needs to be cleared up

CHL has nothing to do with possession. A CHL holder can illegally possess a firearm, and then he would no longer be protected by this bill.

    Ding, ding, ding. Winner.

Not true. The commas separate the conditions. By your logic a peace officer could not carry their weapon but a CHL holder could.

If the intent was for anyone "legally possessing a firearm" to be protected, there would be no reason to list "holds a license to carry a concealed handgun" as a condition. You are correct that this does not apply to Peace Officers, unless they have a CHL.

So, once it goes through and it goes into affect, what do you think the likelihood of large companies changing their policies is? Think they'll.....

    Modify policy and announce it.
Modify policy and keep it low key.
Leave policy unless somebody brings it up.
Leave policy but not enforce it.

I'd like to see them modify the policy, but I will not bring it up. I'll just "start" keeping mine in my truck at work since it'll be okay :)

I have a CHL, dont see how it would effect a LEO with a CHL. Expound?

Unless I am misreading (which certainly could be the case, as the wording of the bill is poor), the bill prohibits companies from terminating or otherwise disciplining employees who bring firearms in their vehicles onto company property, if the employee holds a CHL and is not otherwise unlawfully in possession of the firearm. A Peace Officer working a second job, or a reserve Officer, would not be protected from termination unless he holds a CHL.

I see where you are coming from. Interesting way to interpret. My gut tells me that an employer would be hard pressed to convince a court they were in the right if they fired a LEO over a gun in his car. But I suppose the possibility is there.

EXCEPTIONS. (a) Section 52.061 does not:... (2) apply to:...(F)property owned or leased by a chemical manufacturer or oil and gas refiner with an air authorization under Chapter 382, Health and Safety Code, and on which the primary business conducted is the manufacture, use, storage, or transportation of hazardous, combustible, or explosive materials, except in regard to an employee who holds a license to carry a concealed handgun under Subchapter H, Chapter 411, Government Code, and who stores the handgun in a locked, privately owned motor vehicle in a parking lot, parking garage, or other parking area the employer provides for employees that is outside of a secured and restricted area: (i) that contains the physical plant; (ii) that is not open to the public; and (iii)the ingress into which is constantly monitored by security personnel.

The bill goes on to describe special protections for CHL holders.

Just wondering. The cops I know carry all the time, so I didnt know if anything was different on or off duty. I never asked because I never really thought it to be a issue.
I do know one cop who isnt very efficent with carrying off duty. " I told em I didnt think that was a good idea".

Licensed peace officers in Texas must carry a weapon 24/7 on or off duty. There are thousands of former law enforcement officers who have other jobs now who let Texas sponsor their peace officers license. I think it some sort of homeland security thing. It gives Texas a larger list of potential LEO to turn to in the event of some sort of critical emergency I think.
