TDS at its finest, they are so bent they cannot see their lunatic tactics are helping him.

Not being on CO ballot would propel him like nothing else could.
There's a reason many liberals are shifting sides. Doesn't mean they like Trump, but even a vote dropped from the left would help Trump in a general election. The left will use any means they can to hold onto power, even at the risk of destroying the nation.

"A majority of the court holds that President Trump is disqualified from holding the office of President under Section Three of the Fourteenth Amendment to the United States Constitution."
Say what? Part Three was legally removed in 1872. These great legal minds do not even know the law.
Full Text, Amnesty Act 1872 May 22, 1872

CHAP. CXCIII - An Act to remove political Disabilities imposed by the fourteenth Article of the Amendments of the Constitution of the United States.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled (two-thirds of each house concurring therein), That all political disabilities imposed by the third section of the fourteenth article of amendments of the Constitution of the United States are hereby removed from all persons whomsoever, except Senators and Representatives of the thirty-sixth and thirty-seventh Congresses, officers of the judicial, military, and naval service of the United States, heads of departments, and foreign ministers of the United States.

    APPROVED, May 22, 1872

    Small question re the exceptions:
Why wouldn't the President also be considered an Officer of the military as Commander-in-Chief?

The president was never a post considered in the 14th Amendment. The 14th Amendment was made as insurrection as in civil war or overthrow of the U.S. government, not in protest of the U.S. government. If that were the case, it would invalidate the 1st Amendment. If J6 was an overthrow, it was the lamest attempt. If they were shooting guns rather than cameras inside the capitol, then I can see an argument for insurrection. None of which Trump actually called for.

Agree. My question was just 'in general' rather than tied to now.
I wonder if G. Washington was ever referred to as the CIC. As general, likely maybe; but still considered so later as president?
Just wandering thoughts on a cloudy day.

Posted this in other thread, but adding it here.

Does not matter if it was an insurrection or not. Does not matter if he was convicted of insurrection or not.

What just about every pundit is missing is that only Congress can enforce the provisions of the 14th Amendment, and then, only by legislation.

    Section 5

The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

The Dems are creating a mess. I don't know how to say that and explain my reasoning without writing a giant wall o' text. But Ben Shapiro succinctly makes the point in an entirely not-taking-sides way with observations that should weigh heavy on the hearts of those who value the rule of law.

Keep in mind that all 7 of the Colorado Supreme Court justices are democrat appointees, you should read the dissenting opinions of the 3 justices of the 4 to 3 decision.

If any of the SCOTUS justices vote in favor of Colorado they will surely be seen as political hacks.

So, Clay and Buck were talking this over today and think it may go unanimous in Trump's favor. I am skeptical, but it would be major.
Just knowing what CO has done and after listening to some of the arguments and justices' questions, if I had to bet, I think it will be 9-0 too.

It's such an overreach by the states based on nothing but opinion and emotion and such an open and shut case that any vote upholding throws out any semblance of fairness and balance from a judicial point of view and reeks of raging partisanship.

We know the justices all have their political leanings and tend to vote in a certain direction. They're human after all. But voting with the states in this situation makes them automatically an activist, not a jurist.
