Theoretically a bumble be cannot fly. But they do.
Legally a Cop can not... But they do.
A smile and a 'yes officer' will do more to defuse the interaction than anything.

I am not justifying anything in that video, not even responding relative to it. My only reply herein is to this post:
The important thing is that all heroes made it back home safe at the end of the shift.....
It's just as important as you arriving home safely at the end of the day, don't ya think! I seem to remember thousands of LEOs who called it End of Watch while working and never made it home. At least 17 officers died, so far this year which is just over 1 month old (not inc;uding the FBI agents just killed yesterday) due to line of duty injuries. As for the ones listed here: Law Enforcement Line of Duty Deaths in 2021 (odmp.org), the other 14 or so who died from COVID-19, who knows where they contracted it. Maybe you should ask their loved ones if the important thing was them making it home or it it was those LEOs doing their jobs and thus allowing others to make it home, throughout their careers that were cut short by their deaths!

Need to get that spell check be going.
Do you seriously believe that submitting to a tyrannical cop is the way to go? How about the one in a North Texas community that would demand oral sex before letting you go? I believe he is now in prison.

YouTube has brought us so many of these videos that it almost seems that unless you are a sergeant you don't seem to know the basics, members here with one exception, excluded.

I think he is saying, you don't have to be a dick to an officer just because you are "right". "Because you can" is the worst reason to do anything and is based in ego and will get you in trouble cop or civilian eventually.

I see cops interact with people ALL DAY. Take my word for what you will. These videos are far and away the exception, just like airplanes crashing or anything else [covid] It is bad, which grabs our attention. But the reality is given the number of interactions these kind of failures are not all that common. No excuses or condemnations made for either party.

Actually I was talking about specifics, the specific officers who never made it home due to in the line of duty death - that is no generalization. Anyway, I can see, if you meant that your post just applied to this video, mine was a pointless point in that regard.

Specifically talking about tyrannical cops. We have already seen the unmentionable retired SA cop that claimed every open carry would be stopped and ID every time in San Antonio. Sure you can submit and maybe in jail you can bend over and submit (or else) but outside of jail I don't think I would submit to systemic abuse. To be honest, I have not shown ID in over 30 years and that was a non ticketed traffic stop. I have great respect for LEO but these videos bring that down. I never considered myself a racist either until I see our government applying freebies to people because they are not my color or race. I am seriously having second thoughts about what I should declare myself. Is it better to be white, black, green, red, yellow? I may want to change as per the situation.

    Sasquatch,

Thanks for your excellent explanatory post.

    Cycleguy,

I believe you - Such incompetence displayed by the SAPD is the exception, not the rule.

    SAY WHAT ? HAHAHAHAHA

Often in cases such as this the clause" nor be deprived of life, liberty, or property, without due process of law; " is argued that the false arrest deprived the person of their liberty without due process of law.

    cycleguy explained things very well.
If I can add something to what he has already said.
There's an old saying " 1rst impressions can make a big difference"
The one thing that can make all the difference is "attitude".

I treat cops the way "I" want to be treated.
If they fail to see that, I try to make the interaction short as possible.
If he starts digging for dirt & I know there's nothing to find, I'll ask if I'm free to go.
If that fails, I ask for his supervisor. 99% of the time I'm on my way quickly.

WTF? I am typing on a crappy DELL! I am NOT an English major,so get over that shit.
And I NEVER said "submit". I said to start with a smile and a 'good evening Officer' always be nice, until it becomes time to NOT be nice.
Have you ever had a Cop go full ASSHOLE on you? I had one back in '77. Maryland State Police were generally known as for their professionalism. HOWEVER... one evening I was backing my truck out of the driveway to let the wife out. Over 1/8 mile down the road- siren and lights. Trooper roars around me and locks the brakes sliding sideways across the road in front of me.
He jumps out BARK BARK BARK- OUT OF THE TRUCK,LET ME SEE YOUR HANDS. BARK BARK BARK LISCENSE AND REGISTRATION NOW! Yes Sir, can I help you? BARK BARK BARK I AM GIVING YOU A WARNING TICKET FOR OBSTRUCTING TRAFFICK BARK BARK. No Sir, I will not accept a warning ticket as I have done nothing wrong. If you issue a ticket I can take to a Judge I will sign it and You can have a nice day. BARK BARK BARK I AM GOING TO GIVE YOU A WA RNING TICKET AND YOU ARE GOING TO SIGN IT. No Sir, I am not signing a warning ticket. Am I under arrest? BARK BARK YOU WILL SIGN THIS WARNING TICKET! This went on for 20 min or so with him refusing to give me back my liscense and registration untill I signed the warning ticket. I repeatedly told him I was not going to stroke his ego by signing a bogus warning ticket. If I broke the law write a real ticket. I will be glad to argue this in front of a Judge. By this time at least a dozen neighbors have gathered. All of them knew me well, some since childhood. AND THEN HE PUT HIS HAND ON HIS GUN. ( at this time, I was in my prime, and working heavy outside construction. Long hair, scruffy winter beard I was also 5"11" 210# with a 32 waist and a 27 1/2" collar)
I am here talking to you like a man. I have not raised my voice or made any thing threatining. You have you'r hand on you'r gun. I can only take that as a direct threat to my safety. Please remove you'r hand from the gun. (veins popping out on his neck and forehead) (neighbors frantically callin the police)
I have not raised my voice or threatened you in any way. So, unless you can draw that gun and shoot me before I can crush you'r throat GO FOR IT. Or you can talk to me man to man in a civilized manner. His face got redder, but he took his hand off the gun. The insane testerone contest ended whith his radio screaming ot his name. trooper --- give the man his liscense and registration and tell him to have a good day. This is LT---
I want YOU in my office in 15 minuits! ( his office was in Pikesville about 35-40 miles away.) I stood my ground, as I am not one to relent when I am right. BUT I never raised my voice, and remained civil the whole time.
Thhhe LT. did call and apologise, it seems the Trooper was a Cpl. and he had just become the acting Sgt. of the watch, and I was the first person he saw.
My point is that you should be nice and civil. You never know what that Cop had happen before he stops you. Good morning Officer, or Yes Sir? is how a Civilized person should react.
No Officer I do not want to let you search my car. Do not raise you'r voice, and smile a lot. But never submit to bullshit. Do you have warrant or am I under arrest? No then is there anythig else I can help you with? Then it was nice to meet you, have a nice day. NEVER curse at any Officer, that just makes you another 'piece of shit', and that dehumanizes you.

I agree with you about being civil to a normal LEO.
I wrote tyrannical cop= exercising power in a cruel or arbitrary way.
I too type on a Dell.

Number on rule, always maintain your coll and be civil. Just because the LE officer is acting like an asshole, doesn't mean you can and get away with it. Also remember, many LE officers are wearing body cameras. So if you are remaining calm, and he's getting belligerent, that is going to show up on his camera.

Never get into a pissing match on the side of the road, (so to speak generally.) because it's in his favor, and he can charge you with a myriad of charges, like resisting, assaulting a peace officer, disorderly conduct, ect.

If after the "encounter", take a moment to reflect, and review all the factors of the encounter. Do an honest assessment of your own actions and behavior during the encounter. IF you truly think you were wronged in the encounter, file a formal complaint with his supervisor. Two things, it it was just the officer having an off and rare bad day, it won't probably go much further than him being talked to about the encounter. If the officer has a problem with this being his habitual behavior with the public, your complaint gives them the evidence to officially reprimand him or to terminate his employment. Most LE agencies and departments don't want bad cops or cops that act badly with their interactions with the public.

    1. If you are engaged in an activity that requires a license such as driving a car, hunting, carrying a firearm, etc., then you must provide your license if asked. LE does not need probable cause for anything.
    2. If you are not doing anything that requires a license and you have not been arrested, you do not have to provide ID to LE. Exception: Texas Education Code states that you must ID to LE if asked, if you are on a school campus.
    3. If you are arrested, you must identify yourself to LE.
    4. If you lie about your identification to LE when being questioned, you can be arrested.
