At will employment state. You can be fired for any reason other than discrimination.
But you can sue for being fired for something explicitly allowed by state law.
At will employment state. You can be fired for any reason other than discrimination.
Several years ago at a BP plant, a dog found a fired cartridge in one of the worker's truck. He wasn't disciplined over it.The exxon mobil site in woodlands had us sign an agreement regarding guns.
Couldnt have so much as a spent shotgun hull in your vehicle. And they had dogs sniffing our vehicles
I understand the at will part but just like discrimination there are laws in place to prevent an employer from firing me based on say skin color. I thought this was a state law that protected the employee from firing.
Yes it’s in Texas.. I’ve been back for a year now just never changed my location on hereI'm not really certain how the carry laws in Texas are going to help a person in North Dakota...............
Is this new job in Texas sir?
And the gun too???
“I’m sorry, your services are no longer required and your employment is terminated. You are not eligible for rehire at this time.”
At will means you’re employed at the will of the employer and your employment can be terminated at any time for any reason.
The only time discrimination comes into the question is if you, the (former) Employee can prove your termination was due to one of the protected classes being the cause for your termination.
Ex: veteran goes to work for company, later gets a VA disability rating. Veteran says to employer hey; I’m disabled and I need special accommodation in the form of ergonomic keyboard. Employer responds with I’m sorry, we don’t employ disabled veterans, you’re fired.
That’s discrimination.
But they can fire you.A company posting "No guns allowed" cannot override state law.
A company posting "No guns allowed" cannot override state law.
What law are they attempting to override?
What law are they attempting to override?
But they can fire you.
Normally it's in their handbook as well.
People in Texas sue for wrongful dismissal all the time for reasons other than discrimination. Some of them win.
I pulled in this morning and they are actually 30.06 and 30.07 signs at the entrance of the parking lot... we’ll see what their employee paperwork says
The building is pretty much in the middle of nowhere so that’s not an option... being as they are 30.06 signs and not “don’t have a gun in your car” signs i’m Thinking I’m ok.. unless it’s in the employee hand book or i’m told not to in the class I’m taking I think I’m fineThis ain't rocket science, don't ask, don't tell, simply park somewhere other than the company parking lot. Problem solved.
