    Burglery and theft are two different things.

    Shooting people for theft is not legal and frankly immoral. Texas use of force laws seems to make sense most of the time.

    You can't shoot someone stealing your stuff unless it is at night and there is no other way to stop the crook, even if it's on your property, for example.

    The dood would definitely have a weapon pointed at him. Wouldn't shoot unless there was a need, i.e. had weapon pointed at me, pulled one or tried to take mine, etc. but I would use the threat of shooting to apprehend and detain. I won't shoot indiscriminately, but will shoot if I feel its warranted, regardless of what is law.
