    2nd hit on google:

    GRAND JURY WILL DECIDE FATE OF 'HERO' CUSTOMER WHO SHOT AND KILLED ROBBER AT TAQUERIA, HPD SAYS

    This is far as I have gotten in searching. Yes, it would go to a Grand Jury but maybe the police haven't sent it to DA's office to start the process.

    Did you watch the video of it on the earlier pages?
    I watched it shortly after it happened.

    OK, shot some more after BG was clearly incapacitated.

    Stressful situation, lots of adrenaline. Who knows what they would do?

    I usually stay calm until after incident, then think & begin shaking.

    Won’t judge this guy harshly.

    I am not justifying them charging him or taking it to the Grand Jury.

    The video just shows the reason for this happening in a liberal city, like Houston or Austin

    Maybe, haven't found out what has happen between police and DA's office. At a minimum I would think this would have to go to a Grand Jury for decision of trial or no trial.

    WOW! A forum member suggested using a Open Records Request to find out and they replied with public information report to incident #002453523. To quote HPD,

    The Houston Police Department has reviewed its files and since the case is still open pending grand jury referral.

    If anyone wants to follow-up more the HPD incident report is attached. Next question is why hasn't this gone to Grand Jury?

    Good job, DougC! I've seen lawyers on YouTube analyzing the situation, and I sense that they are drooling over the idea of the fees they could collect representing the guy in court. Some suggested that the grand jury may be waiting on autopsy reports.

    Not sure if the autopsy will help any.
    While the perp was standing and with a gun in his hand, he was a deadly threat and the shoot was good and lawful.
    The defender's conduct would become unlawful if it turned out that the felon:
    1) didn't have a gun on the floor and
    2) was still alive

    Based on the video evidence or autopsy, I am not sure they can prove #1 or #2.
    Well, then there's always witness coercion ...
